Adoption is a real choice. People choose it with love, with grief, with logistics, with a full night’s sleep and without one. What it is not, in New Jersey law, is a polite substitute that lets anyone pretend the Freedom of Reproductive Choice Act is optional.
P.L. 2021, c. 375, signed January 13, 2022, codifies the right to terminate a pregnancy or to carry to term. Adoption sits after a decision to continue a pregnancy, or after a birth. It does not legally cancel the abortion right, and nobody gets to use “but you could always adopt” as a statutory argument. That sentence is morality cosplay. It is not the Revised Statutes. Safe Haven is a separate, specific door
The Safe Haven Infant Protection Act (N.J.S.A. 30:4C-15.5 et seq.) is for a crisis after a baby is here. Official nj.gov/njsafehaven: a parent, or someone acting for them, may leave an unharmed infant less than 30 days old with staff at a hospital, police station, fire station, or ambulance, first aid, or rescue squad that is staffed 24 hours a day, 7 days a week. Safely. Legally. Anonymously if there is no abuse. No names are required when the infant is unharmed.
DCF takes custody and places the child in a foster or pre-adoptive home. Hotline and location help: resources on the Safe Haven site, including 1-877-839-2339. A 2023 amendment also addresses leaving a newborn at the hospital after giving birth there when the circumstances show an intent not to return. Read the State pages, not a Facebook aunt.
Safe Haven is not prenatal health care, and it is not an abortion. It is an off-ramp so no one has to abandon a baby in a place that is not safe. Planned adoption through an agency or private process is another off-ramp, with names, counseling, and court process. Both are choices. Neither rewrites P.L. 2021, c. 375. Dobbs did not ban abortion in New Jersey; it also did not turn adoption into the State’s preferred substitute for a constitutional and statutory right.

Adoption through an agency is a real, named, counseled process. Safe Haven is a crisis off-ramp. Abortion is a statutory and constitutional right in New Jersey under P.L. 2021, c. 375 and the State Constitution the Act codifies. Three different gardens. Carry to term is in the same Act as the right to terminate. Adoption can follow a birth. It does not legally replace the abortion right, and it does not have to be justified to a stranger on the internet.
